IALANA Statement on Cluster Munition Transfer and Use
The International Association of Lawyers Against Nuclear Arms (IALANA) has issued a statement titled “The Illegality of U.S. Cluster Munitions Delivery to Ukraine under International Law – and the Positive Obligation of the U.S. to Avoid or Minimize the Humanitarian Suffering Caused by These Weapons.” The statement notes that both the Russian and Ukrainian militaries have used cluster munitions in the course of the war, and argues that although the United States, Russia, and Ukraine are not parties to the Cluster Munitions Convention, the use of cluster munitions likely is illegal under general principles of humanitarian and human rights law.
